فَاَنۡجَیۡنٰہُ وَ اَہۡلَہٗۤ اِلَّا امۡرَاَتَہٗ ۫ ۖکَانَتۡ مِنَ الۡغٰبِرِیۡنَ ﴿۸۳﴾
آخرِکار ہم نے لوط اور اس کے گھر والوں کو ۔ ۔ ۔ ۔ بجز اس کی بیوی کے جو پیچھے رہ جانے والوں میں تھی ۔ ۔ ۔ ۔ 66
Surat ul aehraaf ayat no 84
وَ اَمۡطَرۡنَا عَلَیۡہِمۡ مَّطَرًا ؕ فَانۡظُرۡ کَیۡفَ کَانَ عَاقِبَۃُ الۡمُجۡرِمِیۡنَ ﴿٪۸۴﴾ 17 بچا کر نکال دیا اور اس قوم پر برسائی ایک بارش 67 ، پھر دیکھو کہ ان مجرموں کا کیا انجام ہوا ۔ 68 ؏ ١۰
سورة الْاَعْرَاف حاشیہ نمبر :67
بارش سے مراد یہاں پانی کی بارش نہیں بلکہ پتھروں کی بارش ہے ، جیسا کہ دوسرے مقامات پر قرآن مجید میں بیان ہوا ہے ۔ نیز یہ بھی قرآن میں ارشاد ہوا ہے کہ ان کی بستیاں اُلٹ دی گئیں اور انہیں تلپٹ کر دیا گیا ۔
سورة الْاَعْرَاف حاشیہ نمبر :68
یہاں اور دوسرے مقامات پر قرآن مجید میں صرف یہ بتایا گیا ہے کہ عمل قوم لوط ایک بدترین گناہ ہے جس پر ایک قوم اللہ تعالیٰ کے غضب میں گرفتار ہوئی ۔ اس کے بعد یہ بات ہمیں نبی صلی اللہ علیہ وسلم کی رہنمائی سے معلوم ہوئی کہ یہ ایک ایسا جرم ہے جس سے معاشرے کو پاک رکھنے کی کوشش کرنا حکومت اسلامی کے فرائض میں سے ہے ، اور یہ کہ اس جرم کے مرتکبین کو سخت سزا دی جانی چاہیے ۔ حدیث میں مختلف روایات جو حضور صلی اللہ علیہ وسلم سے مروی ہیں ، ان میں سے کسی میں ہم کو یہ الفاظ ملتے ہیں کہ اقتلو ا الفاعل و المفعول بِہٖ ( فاعل اور مفعول کو قتل کر دو ) ۔ کسی میں اس حکم پر اتنا اضافہ اور ہے کہ احصنا اولم یحصنا ( شادی شدہ ہوں یا غیر شادی شدہ ) ۔ اور کسی میں ہے فارجموا الاعلی و الاسفل ( اُوپر اور نیچے والا ، دونوں سنگسار کیے جائیں ) ۔ لیکن چونکہ نبی صلی اللہ علیہ وسلم کے زمانہ میں ایسا کوئی مقدمہ پیش نہیں ہو ، اس لیے قطعی طور پر یہ بات متعین نہ ہو سکی کہ اس کی سزا کس طرح دی جائے ۔ صحابہ کرام میں سے حضرت علی رضی اللہ عنہ کی رائے یہ ہے کہ مجرم تلوار سے قتل کیا جائے اور دفن کرنے کے بجائے اس کی لاش جلائی جائے ۔ اسی رائے سے حضرت ابوبکر رضی اللہ عنہ نے اتفاق فرمایا ہے ۔ حضرت عمر اور حضرت عثمان کی رائے یہ ہے کہ کسی بوسیدہ عمارت کے نیچے کھڑا کر کے وہ عمارت اب پر ڈھا دی جائے ۔ ابن عباس کا فتویٰ یہ ہے کہ بستی کی سب سے اُونچی عمارت پر سے ان کو سر کے بل پھینک دیا جائے اور اوپر سے پتھر برسائے جائیں ۔ فقہاء میں سے امام شافعی کہتے ہیں کہ فاعل و مفعول واجب القتل ہیں ، خواہ شادی شدہ ہوں یا غیر شادی شدہ ۔ شعبی ، زُہری ، مالک اور احمد رحمہم اللہ کہتے ہیں کہ ان کی سزا رجم ہے ۔ سعید بن مُسَیَّب ، عطاء ، حسن بصری ، ابراہیم نخعی ، سفیان ثوری اور اوزاعی رحمہم اللہ کی رائے میں اس جرم پر وہی سزا دی جائے گی جو زنا کی سزا ہے ، یعنی غیر شادی شدہ کو سو کوڑے مارے جائیں گے اور جلا وطن کر دیا جائے گا ، اور شادی شدہ کو رجم کیا جائے گا ۔ امام ابوحنیفہ کی رائے میں اس پر کوئی حد مقرر نہیں ہے ، بلکہ یہ فعل تعزیر کا مستحق ہے ، جیسے حالات و ضروریات ہوں ان کے لحاظ سے کوئی عبرت ناک سزا اس پر دی جاسکتی ہے ۔ ایک قول امام شافعی سے بھی اسی کی تائید میں منقول ہے ۔
معلوم رہے کہ آدمی کے لیے یہ بات قطعی حرام ہے کہ وہ خود اپنی بیوی کے ساتھ عمل قوم لوط کرے ۔ ابوداؤد میں نبی صلی اللہ علیہ وسلم کا یہ ارشاد مروی ہے کہ ملعون من اتی المرٲتہ فی دبرھا (عورت سے یہ فعل کرنے والا ملعون ہے) ۔ ابن ماجہ اور مسند احمد میں حصور کے یہ الفاظ منقول ہیں کہ کہ لا ینظر اللہ الی رجل جامع امراتہ فی دبرھا ( اللہ اس مرد کی طرف ہرگز نظر رحمت سے نہ دیکھے گا جو عورت سے اس فعل کا ارتکاب کرے ) ۔ ترمذی میں آپ کا یہ فرمان ہے کہ من اتی حائضا او امرٲة فی دبرھا او کاھنا فصدّقہ فقد کفر بما انزل علیٰ محمّد صلی اللہ علیہ وسلم (جس نے حائضہ عورت سے مجامعت کی ، یا عورت کے ساتھ عمل قوم لوط کا ارتکاب کیا ، یا کاہن کے پاس گیا اور اس کی پیشن گوئیوں کی تصدیق کی ، اس نے اس تعلیم سے کفر کیا جو محمد صلی اللہ علیہ وسلم پر نازل ہوئی ہے ) ۔
